Despite insurance companies’ best efforts, in 2007, voters in Washington passed Referendum 67, a law that made it unlawful for insurers to unreasonably deny claims filed by their insureds. This new law allows for treble damages and attorney fees when, after a trial, a judge or jury determines that an insurance company denied a valid insurance claim.
This new law has helped to alleviate a major insurance problem. Some accident and personal injury victims file claims which are then denied, in bad faith, by insurance companies. If you have been injured in an accident, and you feel your insurance company has unfairly denied your claim, the insurance company may have acted in bad faith, and you may be entitled to treble damages and attorney fees.
